3. General information on data processing

We collect and use our users’ personal data only where this is required for the provision of a functional website, as well as our content and services.

3.1. Personal data

Personal data is any information relating to an identified or identifiable natural person. This includes, for example, information such as your name, age, address, telephone number, date of birth, email address, IP address or user behaviour. Information for which we cannot (or can only with disproportionate effort) establish a link to your person, e.g. by anonymising the information, is not personal data.

3.2 Processing of personal data

Processing is defined as any operation or series of operations, with or without the aid of automated processes, that involves personal data, such as collection, entry, organisation, sorting, storage, adaptation or alteration, reading, querying, use, disclosure through transmission, dissemination or another form of provision, matching or linking, restriction, deletion or destruction.

3.3 Legal basis for the processing of personal data

Personal data is regularly collected and used only with the user’s consent. Insofar as we obtain the consent of the data subject for processing operations of personal data, the legal basis is Art. 6 (1) lit. a GDPR.

An exception is made for cases in which prior consent cannot be obtained for practical reasons and if processing of the data is permitted by law. In case of processing of personal data that is necessary for the performance of a contract to which the data subject is a party, Art. 6 (1) lit. b GDPR is the legal basis. This also applies for processing operations required for the implementation of precontractual measures.

If processing of personal data is necessary for compliance with a legal obligation to which we are subject, Art. 6 (1) c GDPR is the legal basis.

If the processing is necessary for the purposes of the legitimate interests pursued by the joint controllers or by a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the first-mentioned interest, Art. 6 (1) lit. f GDPR is the legal basis.

4. Data processing operations

Personal data is collected via this website if you provide it to us of your own accord, e.g. by filling in forms or sending e-mails. We use this data for the purposes stated in each case or those resulting from the enquiry, e.g. providing your e-mail address, in order to contact you. Data is only transmitted to third parties if this is expressly permitted by law or if you have consented to the transmission in the course of an active business relationship.

4.1 Informational use of the website

If you make use of the option to send us enquiries using our contact form, we process your first and last name, your e-mail address and your company. Furthermore, you can voluntarily provide your telephone number. Furthermore, you can send us an individual message via the message field. It is entirely up to you whether you provide us with this data. However, without this information we will be unable to meet your contact request or only meet it in part.

The data processing described above for the purpose of contacting you and processing your contact is carried out in accordance with Art. 6 Para. 1 lit. b or f GDPR.

4.3 Webinars

On our website, we offer you the possibility to register for webinars of the partners of Smart-Cabinet-Building. For this purpose, our website contains so-called hyperlinks to the partners' company websites, which you can use to register for a webinar. Clicking on these hyperlinks takes you from our website directly to the website of the other providers. This can be identified through the change in the URL, etc. We cannot accept any responsibility for the confidential handling of your data on other websites. Please inform yourself about the handling of your personal data on other websites directly on the respective websites. In order to be able to use the webinar, you must register for it on the respective company pages of the partners. For this purpose, your e-mail address, company details and country details will be processed. Furthermore, you can voluntarily enter your first name and surname. It is your free decision whether you provide this data. However, a webinar cannot be offered without this information.

The registration data will be passed on to the partners of Smart-Cabinet-Building for the purpose of contacting interested parties or customers for the purpose of consultation, preparation of offers, etc.

The aforementioned data exchange between the partners of the Smart-Cabinet-Building is carried out in accordance with Art. 6 para. 1 lit. b or lit. f GDPR (see also clause 14).

5. Transfer of personal data among the joint controllers

When using the contact form, your personal data is transferred to the respective responsible partners of Smart Cabinet Building, depending on the product requested. This serves the purpose of preparing the offer, processing the contract and/or providing general advice.

Data processing for the purpose of transmission is carried out in accordance with Art. 6 Para. 1 lit. b or f GDPR.

6. Transmission of personal data to third parties

As a general rule, your personal data is not passed on to third parties. Your personal data is only passed on to third parties or otherwise transmitted if

• we are legally obliged to do so on the basis of an official or judicial order;

• we are entitled to do so, e.g. because this is required in order to prosecute a criminal offence or to exercise and enforce our rights; or

• you have given prior consent

7. Cookies and external services

Cookies are small files that enable specific information related to the device to be stored on the user's access devices (PC, smartphone or similar). They serve the user-friendliness of websites and thus the users. Some functions of our website cannot be offered without the use of technically necessary cookies. In addition, they can be used to collect statistical data on website use and analyse it for the purpose of improving the website. Users can influence the use of cookies. For more information on the use of cookies on our website and for individual cookie settings, click HERE.

8. Security measures to protect the data stored by us

We pledge to protect your privacy and to treat your personal data confidentially. To prevent loss or misuse of the data we save, we take comprehensive technical and organisational safety precautions, which are regularly reviewed and updated in keeping with the latest technological advances. However, you should be aware that the Internet is structured in such a way that data protection rules or the above security measures may not be observed by other persons or organisations outside our sphere of influence. In particular, it is possible for unencrypted data to be read by third parties – even if this is sent by e-mail. We have no technical influence over this. It is the responsibility of the user to protect from misuse any data made available either by way of encryption or by other methods.

9. Hyperlinks

Our website contains so-called hyperlinks to websites of other providers. Clicking on these hyperlinks takes you from our website directly to the website of the other providers. These can also be the company websites of the Smart-Cabinet-Building partners. This can be identified through the change in the URL, etc. We cannot accept any responsibility for the confidential handling of your data on other websites. Please inform yourself about the handling of your personal data on other websites directly on the respective websites.

10. External service providers

We deploy service providers to render services and process your data concerning our services. The service providers process the data exclusively within the limits of our instructions and are obliged to comply with the applicable data protection legislation. All processors have been carefully selected and only receive access to your data to the extent and for the necessary period required for rendering the services, or to the extent of the data processing and use to which you have consented.

In this context, personal data may be transferred to countries outside the EU/EEA, in particular to the USA. In order to be able to guarantee adequate protection of your personal data in the event of the transfer of personal data to such so-called third countries, we have concluded so-called EU-US standard contractual clauses with our service providers. The European Court of Justice considers the USA to be a country with an insufficient level of data protection under EU standards. Because no adequacy decision has been adopted, and because no relevant guarantees have been provided, there is a risk, in particular, that your data may be processed by US authorities for controlling and monitoring purposes, possibly without any legal recourse for you. In addition, we are in constant contact with the service provider to ensure the protection of your personal data with any additional measures that may be required.

11. Storage period

Your personal data will be deleted as soon as the respective purpose for processing has been achieved or has subsequently ceased to apply.

In order to fulfil contractual obligations, data collected from you may be retained for as long as the contract exists and, depending on the scope of the contract, for 6 or 10 years beyond that to comply with legal retention obligations and to resolve any enquiries or claims that may arise after the contract expires.

If, at our discretion, data is necessary to investigate or defend claims against us or to bring a prosecution or claim against you, us or a third party, we may retain it for as long as such proceedings might be brought.

For customer service purposes, data collected from you may be retained for 3 to 10 years after collection unless you request that we delete this data and there are no contractual or statutory retention obligations that conflict with this request for deletion.

Relevant obligations to provide proof and to retain data result, among others, from the German Commercial Code (Handelsgesetzbuch) and the German Fiscal Code (Abgabenordnung).

In this case, the legal basis for the processing is the respective legal regulation in conjunction with Art. 6 Para. 1 lit. c GDPR.

If a contract is not concluded, we will delete your data after 3 years at the end of the statutory limitation period.

12. Data subject rights

12.1 Right to information, Art. 15 GDPR

You have the right to demand information from us at any time about what data we have stored about you, its origin, and the recipients or categories of recipients to whom this data is passed on and the purpose of storage.

12.2 Right of revocation, Art. 7 (3) GDPR

If you have granted consent to the use of data, you can revoke this at any time with future effect, without providing reasons. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until revocation. For this purpose, it is sufficient to send an e-mail to datenschutz@weidmueller.de or a written notification to Weidmüller Interface GmbH & Co. KG, Klingenbergstraße 16, 32758 Detmold, in each case quoting the keyword: smart-cabinet-building.

12.3 Right of rectification, Art. 16 GDPR

If your personal data stored by us is incomplete or incorrect, you can demand its immediate completion or correction.

12.4 Right to erasure and blocking, Art. 17 and 18 GDPR

You have the right to block and delete your personal data stored by us. Should deletion conflict with legal, contractual, fiscal or commercial retention periods or other legal causes, your data may be blocked instead.

12.5 Right of data transfer, Art. 20 GDPR

Should you demand the return of personal data provided to us, we will issue or transmit the data to you or another responsible person, as you wish, in a structured, common and machine-readable format. However, the latter option is only performed if technically possible.

12.6 Right to object, Art. 21 GDPR

Under the provisions of Art. 21 GDPR, you have the right at any time for reasons based on your special situation to object to the processing of your personal data if data processing is carried out based on our legitimate interest under Art. 6 (1) (f) GDPR.

12.7 Contact for the assertion of data subject rights

To assert your data subject rights, you can contact us by e-mail at datenschutz@weidmueller.de - or by post mail at Weidmüller Interface GmbH & Co. KG, Klingenbergstraße 16, 32758 Detmold, in each case under the keyword: smart-cabinet-building.

The parties to the smart-cabinet-building cooperate to ensure that the rights of the data subjects are properly fulfilled. In this respect, Weidmüller Interface GmbH & Co. KG acts as a contact point within the meaning of Article 26 (1) sentence 3 of the GDPR. This means that data subjects can contact Weidmüller Interface GmbH & Co. KG directly. Weidmüller Interface GmbH & Co. KG works in partnership with the other data controllers when answering queries and fulfilling data subject rights, but acts as a point of contact on behalf of the other partners when communicating with the data subject.

When you contact us, the data you provide (your e-mail address, name and telephone number, if applicable) will be stored by us in order to answer your questions or respond to your request. We delete the data arising in this context once storage is no longer required, or restrict processing if statutory retention obligations apply.

13. Right of complaint to the supervisory authority, Art. 77 GDPR

You have the right to lodge a complaint with the competent supervisory authority concerning the processing of your personal data if you consider your rights under the GDPR to be violated.

14. Data transfer to affiliated companies of the Smart-Cabinet-Building partners

Insofar as affiliated companies exist at the respective partners, data may be transferred to them for operational reasons and to ensure IT operations and IT security. The legal basis for this is Art. 6 para. 1 lit. f GDPR.

15. Automated decision-making/profiling

We do not use automated decision-making or profiling (an automated analysis of your personal circumstances).
